Terms of Service

These Terms of Service (“Terms”) govern your use of HealthBit, a fitness social platform operated by HealthBit (“we”, “us”, or “our”). By creating an account or using HealthBit, you agree to these Terms. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 13 years old to use HealthBit. By using our services, you confirm that you meet this requirement and have the legal capacity to enter into these Terms in your jurisdiction.

2. Your Account

• You are responsible for maintaining the security of your account and password
• You must provide accurate and complete information when creating your account
• You may not impersonate another person or use a username that is offensive or misleading
• You must notify us immediately of any unauthorized access to your account
• We reserve the right to terminate accounts that violate these Terms

3. Acceptable Use

You agree not to:

• Post false, misleading, or fraudulent fitness data or activities
• Manipulate the XP leaderboard through exploits, scripts, or unauthorized means
• Harass, bully, or discriminate against other users
• Share content that is illegal, pornographic, or incites violence
• Attempt to reverse engineer, scrape, or extract data from HealthBit
• Use automated bots or scripts to interact with the platform
• Sell, transfer, or share your account credentials with others
• Interfere with or disrupt HealthBit's servers or infrastructure

4. User Content

You retain ownership of content you post on HealthBit (activities, photos, comments). By posting content, you grant HealthBit a non-exclusive, worldwide, royalty-free license to display and distribute that content within the platform. You represent that you have the right to post any content you share.

Public activity pages may be indexed by search engines. If your profile is set to Private, your activities will not be publicly visible or indexed.

5. Pro Subscription

• Pro subscriptions are billed monthly or annually via Stripe
• Prices are listed in Indian Rupees (INR) and may be subject to GST
• You may cancel your Pro subscription at any time; access continues until the end of the billing period
• We do not offer refunds for partial subscription periods unless required by applicable law
• We reserve the right to change Pro pricing with 30 days' notice

6. AI Features & Accuracy

HealthBit uses Google Gemini to provide AI coaching, activity enrichment, and weekly reports. AI-generated content is for informational and motivational purposes only and does not constitute medical advice. Always consult a healthcare professional before making significant changes to your fitness routine. HealthBit is not responsible for decisions made based on AI-generated content.

Free users are limited to 3 AI uses per week. Pro users have unlimited access to AI features.

7. Health & Fitness Disclaimer

HealthBit is a social fitness tracking platform, not a medical service. Activity data (distance, calories, pace) is provided for informational purposes and may not be perfectly accurate. Consult a physician before starting any new exercise program. HealthBit is not liable for injuries or health issues arising from activities logged or suggested on the platform.

8. Intellectual Property

HealthBit and its logos, design, code, and features are the intellectual property of HealthBit. You may not copy, reproduce, or create derivative works from HealthBit without our written permission. Our name and logo may not be used without prior consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, HealthBit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the service.

HealthBit's total liability for any claims related to these Terms shall not exceed the amount you paid to HealthBit in the 12 months preceding the claim.

10. Service Availability

We aim for high availability but do not guarantee that HealthBit will be available 100% of the time. We may perform maintenance, add or remove features, or temporarily suspend the service without notice. We are not liable for any losses caused by downtime.

11. Termination

You may delete your account at any time via Settings → Danger Zone → Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms without prior notice. Upon termination, your data will be deleted per our Privacy Policy.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of HealthBit shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India. We encourage you to contact us first to resolve disputes amicably before initiating legal proceedings.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 7 days before taking effect. Continued use of HealthBit after changes constitutes your acceptance of the updated Terms.
